Berkhamsted Castle Trust – Save Castle Fields “Save Your Space” Campaign Terms & Conditions

1. Welcome

Thank you for supporting Berkhamsted Castle Trust to help Save Castle Fields.

Our “Save Your Space” campaign is a simple and meaningful way to help us protect land for future generations.

By making a donation through this Campaign, you (“the Donor”) agree to these Terms and Conditions.

Summary of terms and conditions

• A £39 donation sponsors a symbolic 3m x 3m square, additional donations can be made
• You’ll receive a what3words location to represent the space you saved
• You do not own the land but can visit the land if safe to do so
• Gift Aid is extra and doesn’t count toward the space
• Spaces are randomly assigned and can’t be changed

2. Nature of the Campaign

2.1 The Campaign invites donations to support the Trust’s efforts to purchase and protect land for conservation and public benefit.

2.2 As part of the Campaign, donors are invited to “save your space” a 3m x 3m square of land, identified as a what3words location.

2.3 The sponsorship model is a symbolic and illustrative fundraising mechanism only.

2.4 Symbolic ownership is for period of the campaign only.

3. Donation and Sponsorship

3.1 The donation amount is £39 per 3m x 3m space and can include additional sponsorship.

3.2 Upon donation, the Donor will be allocated a unique what3words location corresponding to a space within the campaign area.

3.3 The allocated space is intended to help donors visualise the impact of their contribution.

3.4 Donations are voluntary and non-refundable, except where required by law.

3.5 Donations below £39 will not be allocated a space but will be combined with other donations amounts to create ‘Community Sponsored’ space

3.6 Donations exceeding £39 are encouraged and the total donation will be divisible by £39. All spaces will be assigned to the donor and, where we can, we will provide spaces adjacent to each other. Where the total donation is not divisible by £39, total full space will be allocated and remaining amount assigned to ‘Community Sponsored’ spaces, for example a £100 donation results in the donor receiving two spaces and remaining £22 contributes to a ‘Community Sponsored’ space

3.7 Donations between £390-£974 will be allocated 10-24 spaces and gain a ‘Castle Fields Champion’ status. Donations over £975 will be allocated 25+ space and gain a ‘Castle Fields Ambassador’ status. This will be presented on the map

4. Important: This Is a Donation (Not Ownership)

4.1 Sponsoring a space is purely symbolic. It does not give you:

• Ownership of land
• Legal rights or interest in the land
• Exclusive access
• The ability to control or manage the land

You’re supporting the work of Berkhamsted Castle Trust to guard the land —not purchasing property for yourself.

4.2 The Donor acknowledges that:

• The land remains (or will remain) under the ownership and control of the Trust or relevant legal landowner
• Sponsorship is purely symbolic

5. Space Allocation

• Each donation corresponds to one 3m x 3m square space
• Spaces are randomly assigned, where we can, we will provide spaces adjacent to each other.
• Once assigned, spaces cannot be exchanged, transferred, or changed by Donors
• Once this campaign has concluded and the loan is fully paid we may arrange subsequent campaigns which could again use the same space for other people to sponsor
• The Trust reserves the right to reassign or adjust spaces allocations if necessary

6. Visiting ‘Your’ space

We love the idea of you connecting with the land you’re helping to protect

• You’re welcome to visit the general area where access is publicly permitted and it is safe to do so
• We cannot guarantee access to every specific space
• All visits are at your own risk and must respect the countryside and local guidelines
• Normal legal restrictions apply to this land and must be followed, for example no land should be disturbed including no unauthorised metal detecting, nor should any item be left or placed on the land.

7. Gift Aid

If you are eligible and choose to apply Gift Aid:

• Your donation may be increased at no extra cost to you
• Gift Aid is added on top of your donation
• It does not count toward the £39 required to sponsor a 3m x 3m space

8. Fundraising via JustGiving

In addition to direct donations, supporters may raise funds themselves through JustGiving, but it is the responsibility of the fundraiser to share donor information to assign spaces

• Funds raised via JustGiving which is connected to the Berkhamsted Castle JustGiving account can be applied toward sponsoring spaces
• The same terms apply to these donations
• Space allocation will be arranged once sufficient funds are received
• If fund raisers get permission from their donors to do so, we can allocate spaces to donations they have received

9. How Your Donation Is Used

Your support helps Berkhamsted Castle Trust:

• Repay the loan taken out to purchase the land
• Protect it for nature and future generations
• Maintain and manage it responsibly

10. Staying in Touch

If you choose to opt in to updates:

• You’ll receive newsletters and campaign updates from Berkhamsted Castle Trust
• Communications will be sent in line with UK GDPR and data protection laws
• You can unsubscribe at any time

11. Changes to the Campaign

We may occasionally need to update or adapt the campaign or these terms. If we do, the terms will be updated on our website.

11.1 The Trust reserves the right to:

• Modify or withdraw the Campaign at any time
• Update these Terms and Conditions

12. Your Data

12.1 Donor data will be handled in accordance with applicable UK data protection laws.

12.2 Personal information will only be used for:

• Administering donations
• Display donations on the interactive map, if provided
• Promoting donations names and messages if permission provided
• Communicating about the Campaign
• Other purposes as outlined in the Trust’s Privacy Policy

12.3 Donors have the choice to opt-in to their name and details being shown on the Campaign interactive map and specifically for use in promotional materials

12.4 Donors should use their own name or that of those they are gifting for. Any name or other submission deemed to be offensive or otherwise inappropriate will be removed and not displayed

13. Liability

Berkhamsted Castle Trust is not responsible for:

• Any loss, injury, or damage when visiting land
• Temporary or permanent changes to access
• Changes to land condition or management

Nothing in these terms limits liability where it cannot legally be excluded.

14. Governing Law

These terms are governed by the laws of England and Wales.
